General Terms and Conditions (GTC) of DerHolzapfel
§ 1 Basic Provisions
(1) The following terms and conditions govern contracts concluded with us as the provider (DerHolzapfel) via the website www.derholzapfel.com. Unless otherwise agreed, we hereby object to the inclusion of any of your own terms and conditions that you may use.
(2) A consumer within the meaning of these regulations is any natural person who enters into contracts primarily for purposes that are neither commercial nor self-employed. Entrepreneurs are natural or legal persons or partnerships with legal capacity who enter into contracts in the course of their commercial or self-employed professional activity.
§ 2 Conclusion of Contract
(1) The subject matter of the contract is the sale of meat and sausage products.
(2) When we present a product on our website, we are already making a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.
(3) The contract is concluded via the Shopify online shopping cart system as follows: You put the desired goods into the "shopping cart" and then proceed to "checkout". There you enter your personal data as well as payment and shipping information. You will then receive an order overview. By clicking on the order button, you submit a legally binding acceptance of the offer, thereby concluding the contract.
(4) Your requests to create an offer are non-binding. We will submit a binding offer to you in text form (e.g. by email) which you can accept within 5 days (unless another deadline is specified in the offer).
(5) Order processing and the transmission of all information required for the conclusion of the contract are carried out by email, partly automated. It is your responsibility to ensure that your provided email address is correct and that the receipt of emails is technically guaranteed, without being prevented by SPAM filters.
§ 3 Prices, Shipping Costs, and Delivery Conditions
(1) Our prices quoted are final prices and include statutory value-added tax as well as all other price components. In addition, shipping costs of 11.50 euros are indicated. We use DPD Food Express shipping for the dispatch of our products.
(2) The exact shipping costs are displayed during the ordering process depending on your delivery address and the order value.
(3) Delivery is made taking into account the special requirements for freshness and shelf life of the products. We guarantee adequate cooling during transport and use special packaging to maintain the quality of our products.
§ 4 Claims for Deviations in Weight and Defects
(1) You have the right to lodge a complaint if the delivered goods do not correspond to the item description in terms of weight or due to other defects.
(2) Claims due to deviations in weight or other defects must be submitted to us within 48 hours after receipt of the goods by you. After this period, such claims cannot be considered.
(3) To assert the complaint, please contact us using the contact details provided. Please describe the defect in detail and, if possible, attach meaningful photos.
(4) We will promptly examine the complaint and inform you of the result and the further procedure.
§ 5 Right of Withdrawal
(1) Due to the nature of our products (fresh food), the right of withdrawal may be limited. Withdrawal is only possible if the product is not unsuitable for return due to health or hygiene reasons after delivery.
(2) Further information on the right of withdrawal and its conditions can be found in our cancellation policy.
§ 6 Data Protection
(1) We take the protection of your personal data seriously. The collection, processing, and use of personal data are carried out in accordance with the legal data protection regulations and our privacy policy.
(2) In particular, in the context of using the Shopify platform, we observe the applicable data protection regulations and ensure secure processing of your data.
§ 7 Final Provisions
(1) Should individual provisions of this contract be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions of the contract.
(2) Contracts between us and you are subject exclusively to German law. For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the country of the consumer's habitual residence is not withdrawn (principle of favorability).
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.
(4) The place of jurisdiction for all disputes arising from contractual relationships between you and us is our place of business.
